The consent process for publication of clinical images in medical journals varies widely. The extent of this variation is not known. It is also not known whether journals follow their own stated best practices or the guidance of the International Committee of Medical Journal Editors. We assessed consent requirements in a sample of 10 top impact factor general medicine journals that publish clinical images, examining variability in consent requirements for clinical image publication and congruence of requirements with the recommendations of (...) the ICMJE. Clinical image consent requirements varied widely from journal to journal. None of the studied journals, even amongst n = 4 ICMJE members or n = 8 journals who self-report adherence to ICMJE guidelines, comply with all of the recommendations of the ICMJE. Half of studied journals require a journal-specific consent form. Among top medical journals there is significant heterogeneity in consent requirements for clinical images. Variability of consent requirements is neither practical nor rational; inconsistent requirements create uncertainty for authors, present impediments to dissemination of scholarship, and undermine a shared professional understanding of how best to protect patient privacy. We propose adopting a standardized consent form and process for publication of identifiable images in medical journals, with uniform elements and explicit definitions. (shrink)

Socrates is one of the most important yet enigmatic philosophers of all time; his fame has endured for centuries despite the fact that he never actually wrote anything. In 399 B.C.E., he was tried on the charge of impiety by the citizens of Athens, convicted by a jury, and sentenced to death (ordered to drink poison derived from hemlock). About these facts there is no disagreement. However, as the sources collected in this book and the scholarly essays that follow them (...) show, several of even the most basic facts about these events were controversial in antiquity, and the questions persist today: How and why was Socrates brought to trial? Why did the jurors, members of the world's first democracy, find him guilty? When he was given an opportunity to escape execution, why did he refuse to do so and instead accept the punishment that he and his friends agreed was unjustly assigned to him? How exactly did Socrates die? Differences of opinion on these and other issues continue to arouse our curiosity and to challenge new generations of students and scholars. The Trial and Execution of Socrates: Sources and Controversies is the first work to collect in one place all of the major ancient sources on Socrates' death--those of both his critics and his defenders--as well as recent scholarly views. Part I includes new translations of Plato's Euthyphro, Apology, Crito, and the death scene from Phaedo, as well as other ancient sources that shed light on Socrates' trial and execution. HEALY St. John's University Staten Island, New York THE PURPOSE of this paper is to discuss Karl Rahner's emarks upon, and use of, what he called ' indirect methds ' in theology.1 To my knowledge there has been little analysis, beyond incidental treatment, of Rahner's scattered references to these methods.2 In the following pages I (...) hope to remedy this gap, and argue for two interdependent theses : First, by construing Rahner's own theological practice in the light of his remarks on the indirect methods, an apologetic method can be discerned which could prove useful for contemporary theology. Second, reading Rahner from this perspective indicates that his apologetic method is much more situation-relative and occasionalist than has generally been recognized hitherto. According to William Placher,8 the contemporary situation in North American theology is often characterized as one in which two rival models of theology are dominant, the revisionist and the post-liberal (Placher, 17-19). Placher discusses many aspects of each model; here I want to look only at those features which bear upon their different conceptions of the nature of apologetics. According to David Tracy, a leading practitioner of the revisionist model, theology in all its forms must be " determined by a relentless drive to genuine publicness ".4 In order to maintain its public character, theology, like any discipline, must develop a preliminary systematic argument by which to ground its possibility and to ·establish its claims to truth and meaningfulness. This initial apologetics uses universal categories and proceeds in accordance with general criteria, functioning in terms, that is, which " all reasonable persons, whether ' religiously involved ' or not, can recognize as reasonable" (Tracy, 57). Usually it takes the form of a foundational explanatory theory of religious discourse which appeals to the universal nature of the deep structures of religious experience. This general theory of religion provides criteria for the subsequent theology, thereby maintaining the latter's relevance for the general, non-Christian public. The theological method considered appropriate is one which attempts systematically to correlate Christian-specific claims with the deep structures of human experience.5 The post-liberal model, by comparison, is more concerned to preserve Christian identity than to maintain the publicness of Christian discourse. In his Introduction to (...) Logic 1 Irving Copi raises a problem with two of these definitions which he believes forces him to limit the range of propositions which can be used in the square of opposition. Since contrary propositions can both be false, but the falsity of a necessarily true proposition is not possible, a necessarily true proposition has no contrary. Therefore, only contingent propositions can be contraries. Subcontrary propositions can both be true, but the truth of a necessarily false proposition is not possible.2 This problem is rarely raised in other logic texts, but, it is interesting to note, it is mentioned by a number of neoscholastic philosophers, for example, P. The reason is they and Copi interpret the definitions of contrary and subcontrary propositions to mean that the falsity of each contrary proposition is possible and the truth of each subcontrary proposition is possible. It should be mentioned, however, that the position of the philosophers cited above is not entirely the same as Copi's. Copi reasons that these definitions imply that necessary propositions have no contrary or subcontrary. The other philosophers believe that necessary propositions can be contraries and subcontraries. Thus, in the case of necessary propositions contrary and subcontrary propositions are, instead, defined merely in terms of their quantity and quality, not by whether or not they can both be false or can both be true. In this paper I argue that teleology and a proper teleological analysis of the uterus is important for a comprehensive understanding of the rights of the unborn. I argue that a right to life entails the right to use those organs that naturally function for an individual’s survival. Consequently, an unborn child has a right to his mother’s uterus. If this is accepted, bodily-rights arguments for abortion such as those proposed by Judith Jarvis Thomson and David Boonin are completely undermined. (...) While Thomson and Boonin may be justified in arguing the right to life does not always entail the right to use another person’s body, I argue that the right to life of the unborn does entail the right to use their mother’s body. The distinction between literal and figurative use is well-known and embedded in ‘folk linguistics’. According to folk linguistics, figurative uses deviate from literal ones. But recent work on lexical modulation and polysemy shows that meaning deviation is ubiquitous, even in cases of literal use. Hence, it has been argued, the literal/figurative distinction has no value for theorising about communication. In this paper, we focus on metaphor and argue that here the literal–figurative distinction has theoretical importance. The distinction between literal and (...) metaphorical needs to be captured by our account of communication because literal uses transmit information in a way that metaphorical ones do not. We argue that there is a way to explain the literal/metaphorical distinction that preserves the core of the folk-linguistic idea and gives the distinction theoretical relevance. We propose that literal uses of a word are made with the intention to conform to an established practice of use, while metaphorical uses do not so conform, but depend on this pre-existing practice. Our account can deal with data that are problematic for other theories. A further advantage is that it extends naturally to other non-literal uses of words, including metonymy. (shrink)

In a clear account of the mature theology of Thomas Aquinas the author, a theologian himself, reveals the evangelical, pastoral and theocentric character of Aquinas's pre-modern theology.

We argue against the dominant view in the literature that concepts are modulated in lexical modulation. We also argue against the alternative view that ‘grab bags’ of information that don’t determine extensions are the starting point for lexical modulation. In response to the problems with these views we outline a new model for lexical modulation that dispenses with the assumption that there is a standing meaning of a general term that is modified in the cases under consideration. In applying general (...) terms we intend to conform with our linguistic ancestors and in doing so we take facts about the referents of these terms for granted. In cases of lexical modulation we become aware of facts we took for granted and we need to change the facts we take for granted in order to see ourselves as continuing in a practice. These changes result in utterances of the general term referring to different properties. In general, concepts are neither the starting point for lexical modulation nor the standing meanings of words. (shrink)

In this paper, I will argue that heterologous embryo transfer (HET) is malum in se because it involves a disordered use of a woman’s gestative faculty. Against most HET opponents, I will argue for and defend the distinction between the generative faculty or procreation and the gestative faculty or gestation, grounded in St. Thomas Aquinas’s explanation for how faculties are distinguished. Against the advocates of HET, I will argue that a thorough analysis of the gestative faculty and its natural object (...) will help us to demonstrate why HET constitutes a disordered (and therefore illicit) use of a woman’s gestative faculty.
